1. About ProFrame
ProFrame is provided by SCM Digital ("SCM Digital", "we", "us" or "our"), whose postal address is SCM Digital, Unit 137740, PO Box 7169, Poole, BH15 9EL, United Kingdom. You can contact us at proframe@scmdigital.co.uk.
These terms apply to the ProFrame website, desktop software, mobile applications, downloads, subscriptions, updates and related support services (together, the "Service").
2. Your agreement
By buying, downloading, installing or using ProFrame, you agree to these terms. If you buy on behalf of a business, you confirm that you have authority to bind that business. You must be legally capable of entering into a contract and provide accurate purchase and account information.
3. The Service and compatibility
ProFrame helps editors preview supported desktop editing output on compatible mobile devices. The current compatibility requirements are shown on our compatibility section. You are responsible for checking those requirements before purchase and for maintaining compatible hardware, software, network access and third-party editing software.
Performance can vary with your equipment, network and third-party software. We may update technical requirements when reasonably necessary for security, compatibility or continued operation.
4. Plans, prices and payment
Prices, billing periods and the features included in each plan are displayed before checkout. Unless stated otherwise, subscriptions renew automatically at the end of each monthly or annual billing period until cancelled. Taxes may be added where required.
Payments are processed by Stripe or another payment provider identified at checkout. Their own terms and privacy notice also apply. We do not receive your full card number.
5. Licence and permitted use
Subject to payment and these terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to use ProFrame for your own editing work during your active subscription. Single-user plans are for one person and may be limited to the device types stated at checkout. Team use requires an appropriate team licence.
You must not resell, sublicense, share access outside your plan, reverse engineer (except where the law expressly permits it), bypass technical protections, use ProFrame unlawfully, or interfere with the Service or another user.
6. Accounts, downloads and updates
You are responsible for protecting any sign-in details, download links and devices associated with your purchase. Tell us promptly if you believe access has been compromised. We may provide updates, fixes or feature changes. Some updates may be required for the Service to continue working securely or with supported third-party software.
7. Availability and support
We aim to provide a reliable Service but do not promise uninterrupted or error-free availability. Maintenance, security work, internet failures and changes made by Apple, Adobe, Stripe or other third parties may affect operation. Support is available through our contact page.
8. Intellectual property
ProFrame, its software, design, branding, documentation and original content are owned by SCM Digital or our licensors. These terms do not transfer ownership to you. Feedback you voluntarily provide may be used to improve ProFrame without restriction or payment.
ProFrame is independent and is not affiliated with or endorsed by Apple Inc. or Adobe Inc. Final Cut Pro is a trademark of Apple Inc. Premiere Pro is a registered trademark of Adobe Inc.
9. Third-party services
The Service may link to or work with third-party products, including Final Cut Pro, Adobe Premiere Pro, Stripe and device operating systems. We do not control those services and are not responsible for changes, outages or content provided by them. Your use of them is governed by their own terms.
10. Cancellation and refunds
You may cancel renewal through the payment or account controls made available to you, or by contacting us. Cancellation stops future renewal and does not normally create a refund for a billing period already started.
In addition, ProFrame includes a 14-day money-back guarantee. To request it, contact us within 14 days of the original purchase and provide the purchase email and enough information to locate the transaction. Refunds are returned to the original payment method where possible. This guarantee does not limit any statutory rights you may have as a consumer.
11. Suspension and termination
We may suspend or end access where payment is overdue, where these terms are materially breached, where use presents a security or legal risk, or where the Service is discontinued. Where reasonable, we will give notice and an opportunity to resolve the issue.
12. Liability
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights. If you are a consumer, we are responsible for foreseeable loss caused by our breach of these terms, but not for loss that was not foreseeable.
If you use ProFrame for business, we are not liable for lost profits, revenue, business, contracts, anticipated savings, data or indirect loss. To the fullest extent permitted by law, our total liability arising from the Service in any 12-month period is limited to the amount you paid for ProFrame in that period.
You remain responsible for keeping backups of projects and checking edits before publication or delivery.
13. Privacy and cookies
Our Privacy Policy explains how we use personal information. You can review and update optional cookie choices on our Cookie settings page.
14. Changes to these terms
We may update these terms to reflect changes in the Service, law or our business. Material changes will be brought to your attention where reasonably possible. The updated date at the top shows when these terms were last revised.
15. Governing law
These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of the part of the UK where you live. Mandatory rights under the law of your country of residence remain unaffected.
